Remember: a constant has to be something you care about. Desmond probably didn't care much about Daniel. It would have made sense though to use Daniel because he was talking to him in both times, but i think the writers needed a way for Penny to find out that Desmond is still alive and a way for her to track him. Jack, Libby, if she was still alive, even Widmore could have theoretically been Desmond's constant b/c he knew them before. I'm not positive, just my opinion.
